Terms of Use

These Terms of Use (“Terms”) govern access to and use of PilotBooker, including its website, accounts, listings, messaging tools and related services (collectively, the “Platform”). In these Terms, “PilotBooker”, “we”, “us” and “our” refer to the operator of the Platform.

By visiting, registering for, submitting content to, sending a message through, or otherwise using the Platform, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the Platform.

Important: PilotBooker is a self-service online directory and communications platform operated by the U.S. legal entity identified in the footer. We do not provide flight training, conduct examinations, issue licences or ratings, employ the listed training providers, or guarantee that any service will meet a regulator’s, airline’s, employer’s or individual user’s requirements.

1. Acceptance and Incorporated Policies

These Terms apply together with our Privacy Policy, Listing Rules, Aviation Training Disclaimer and, where applicable, Provider Terms and Conditions. Those documents form part of your agreement with us. If a specific feature contains additional terms, those additional terms also apply to that feature.

You agree that electronic acceptance, records, notices and communications may be used in connection with the Platform to the extent permitted by applicable law.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, submit a listing or send a message. If you use the Platform for a company, school, training organisation or other entity, you confirm that you are authorised to bind that entity to these Terms.

You may not use the Platform if your use is prohibited by applicable law, sanctions, court order or regulatory restriction.

Because the Platform is operated by a U.S. entity, access and services are unavailable where prohibited by U.S. sanctions or export-control laws. Users remain responsible for all professional, healthcare, advertising, privacy and other mandatory laws that apply where they or their services are located.

3. Our Directory and Platform Role

Providers listed on the Platform are independent third parties. Unless we expressly state otherwise in writing, PilotBooker is not their agent, partner, joint venturer, representative, employer, training organisation, broker, payment trustee or guarantor.

We provide technology that allows users to discover and contact providers. Any quotation, booking, enrolment, training agreement, payment, refund, rescheduling arrangement, visa support, accommodation, assessment, examination, certification or other service is agreed directly between the user and the relevant provider.

We are not a party to that agreement and do not control how a provider performs its services. Providers normally publish their own content without pre-approval. We may moderate, restrict or remove content after a report, legal request, security signal or policy concern, but we do not verify every listing and have no general duty to continuously monitor every listing or communication.

4. Accounts and Account Security

You must provide accurate, current and complete information and keep it updated. You are responsible for maintaining the confidentiality of your password and for activity carried out through your account, except to the extent caused by our own breach of applicable law.

You must not share, sell, transfer or allow unauthorised use of your account. Notify us promptly through the Contact page if you suspect unauthorised access, compromised credentials or misuse.

We may request reasonable evidence to verify identity, authority, provider status or listing claims. Refusal or failure to provide requested information may result in restricted access, listing removal or account suspension.

5. Provider Listings and Third-Party Regulatory Information

Providers are solely responsible for their listings and must ensure that all descriptions, prices, currencies, availability, locations, approvals, facilities, aircraft or simulator details, prerequisites, exclusions, taxes, refund terms, images and claims are accurate and lawful.

Users must independently verify information before relying on it, including:

  • the provider’s identity, licences, approvals and regulatory standing;
  • whether a course, simulator, aircraft, instructor, examiner or certificate is accepted by the relevant aviation authority, airline or employer;
  • the full price, taxes, additional charges, cancellation rules and refund policy;
  • entry, visa, medical, language, experience and documentation requirements; and
  • current availability, location, dates and service specifications.

PilotBooker does not verify, approve, certify, accredit or endorse Providers or their regulatory status. Any authority name, approval reference, licence, certificate, scope, expiry date or similar information is supplied by a Provider or another third party. Users must independently confirm it with the competent aviation authority and any relevant licensing authority, airline or employer.

6. Messages and Communications

When you send a message, you authorise us to transmit the information you provide to the selected provider so that it can respond. You are responsible for the accuracy and lawfulness of your message and for deciding what personal or confidential information to include.

Providers may use information contained in a message only to respond to that message, providing requested information and conducting legitimate follow-up in accordance with applicable privacy and marketing laws. Users and providers must not use the Platform for spam, harassment, unsolicited bulk marketing or unlawful solicitation.

We may retain, review or disclose communications where reasonably necessary to operate the Platform, investigate abuse, enforce our policies, protect users or comply with law, as explained in our Privacy Policy.

7. Bookings, Contracts, Payments and Refunds

Unless a feature expressly states otherwise, PilotBooker does not accept or hold course fees, deposits or other payments on behalf of providers. Payments made directly to a provider are governed by the agreement and refund terms between you and that provider.

You must review the provider’s written quotation, contract, cancellation policy and refund terms before paying. PilotBooker is not responsible for a provider’s insolvency, cancellation, delay, non-performance, refusal of a refund or any chargeback dispute.

If PilotBooker later offers paid Platform features, the price, billing cycle, taxes, renewal and cancellation terms displayed at checkout or in the applicable provider terms will apply. Nothing in these Terms limits mandatory consumer rights that cannot lawfully be excluded.

7A. Aviation-Medical Directory

PilotBooker may display self-published directory information for independent aviation medical examiners, aeromedical centres, aviation medical clinics and other lawfully authorised aviation-medical providers in multiple countries and authority systems. PilotBooker is not an aviation authority, healthcare provider, medical regulator, clinic, examiner, medical adviser, verification service, booking agent or emergency service.

PilotBooker does not schedule or confirm aviation-medical appointments, process medical-service payments, provide a medical messaging service or transmit medical records. Direct business contact details may be displayed only after a user logs in. Those details are submitted by the provider, are not checked by PilotBooker and may be inaccurate, incomplete or out of date. Login is an access-control step only and is not verification, approval, endorsement or a safety check.

Users must independently confirm the provider’s identity, designation, scope, location and current authority status in official records before contacting, paying or attending. Providers authorise PilotBooker to display only business contact details they are entitled to publish. Users must not scrape, harvest, republish or use gated contact data for spam, unrelated marketing or unlawful purposes.

Do not place medical history, symptoms, diagnoses, medications, mental-health information, previous medical decisions, examination results, medical certificates, identity documents, payment-card data or official medical-application references in PilotBooker, including ordinary Platform messages. The provider must supply its own protected and lawful process for any information it is authorised and required to collect.

8. Acceptable Use

You must use the Platform lawfully and respectfully. You must not:

  • submit false, misleading, fraudulent, defamatory, discriminatory or unlawful content;
  • impersonate another person or misrepresent authority, qualifications, approvals or affiliation;
  • scrape, harvest, copy or systematically extract listings, contact data or other Platform content;
  • send spam, malicious files, phishing messages or unauthorised advertising;
  • circumvent access controls, probe vulnerabilities, introduce malware or interfere with security or operation;
  • reverse engineer, reproduce or commercially exploit the Platform except as lawfully permitted;
  • manipulate reviews, rankings, messages, prices, availability or other Platform signals;
  • use information obtained through the Platform to harass, discriminate against or unlawfully monitor anyone; or
  • use the Platform in a way that infringes intellectual-property, privacy, consumer-protection, aviation, sanctions or other applicable laws.

9. User Content and Licence

You retain ownership of content you submit, such as profile details, listing text, photographs, documents, messages, feedback and reviews (“User Content”). You grant PilotBooker a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, format, publish, display, distribute and otherwise use User Content only as reasonably necessary to operate, secure, promote and improve the Platform.

You confirm that you own or have all rights and permissions needed for your User Content and that our permitted use will not infringe another person’s rights or breach law. You remain responsible for User Content and any claims arising from it.

We may refuse, edit, restrict or remove User Content that we reasonably believe breaches these Terms, creates risk, is inaccurate or is otherwise unsuitable for the Platform. We are not required to retain copies after removal or account closure.

10. Reviews, Feedback and Complaints

Reviews must reflect genuine, first-hand experience and must not be purchased, fabricated, retaliatory or submitted by someone with an undisclosed conflict of interest. We may request evidence, moderate reviews or remove content that breaches our policies, but we do not guarantee that every review is accurate.

Feedback or suggestions you voluntarily provide may be used by us without restriction or payment, provided we do not publicly identify you without permission.

11. Intellectual Property

The Platform’s software, structure, design, branding, logos, text created by us, graphics and other proprietary materials are owned by or licensed to PilotBooker and are protected by applicable intellectual-property laws. Except for the limited right to use the Platform under these Terms, no rights are transferred to you.

You may not use the PilotBooker name, branding or materials in a way that suggests endorsement, partnership or affiliation without prior written permission.

12. Third-Party Services and Links

The Platform may contain links to provider websites, maps, payment services, social networks, email tools or other third-party services. We do not control and are not responsible for their availability, content, security, privacy practices, pricing or performance. Accessing them is at your own risk and subject to their terms.

13. Aviation, Safety and Regulatory Disclaimer

Information on PilotBooker is general directory information, not aviation, regulatory, legal, medical, financial, immigration, career or safety advice. Never rely on a listing or Platform communication as a substitute for confirmation from the relevant aviation authority, approved training organisation, examiner, airline, employer, medical examiner or other qualified professional.

Aviation requirements vary by authority, licence state, aircraft type, course, operator, employer and individual circumstances, and they may change. PilotBooker does not guarantee eligibility, admission, course completion, examination success, licence issuance, rating endorsement, licence conversion, employment, interview success, visa approval or any training outcome.

Users are responsible for complying with all applicable safety rules, medical requirements, licensing conditions and lawful instructions. Nothing on the Platform authorises unsafe or unlawful aviation activity.

14. Platform Availability and Changes

We may modify, suspend, restrict or discontinue all or part of the Platform, introduce or remove features, impose usage limits, or perform maintenance at any time. We do not promise uninterrupted, error-free or permanent availability and are not responsible for delays or failures caused by events outside our reasonable control.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis. PilotBooker disclaims all express, implied and statutory warranties, including warranties of accuracy, completeness, merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, availability and security.

We do not warrant or guarantee any provider, user, listing, review, quotation, price, availability, response, training service, regulatory approval or outcome. Your dealings with providers and other users are undertaken at your own judgment and risk.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any mandatory consumer right and, where applicable, liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by negligence.

Subject to the paragraph above and to the maximum extent permitted by law, PilotBooker and its owners, officers, employees, contractors and affiliates will not be liable for:

  • indirect, incidental, special, exemplary, punitive or consequential loss;
  • loss of profit, revenue, opportunity, business, goodwill, data or anticipated savings;
  • the acts, omissions, statements, insolvency or performance of any provider or user;
  • any training, assessment, examination, booking, payment, refund, travel, accommodation, visa, employment or regulatory outcome; or
  • unauthorised access, service interruption, malware or third-party systems beyond our reasonable control.

Where liability cannot be excluded, our total aggregate liability arising from or relating to the Platform or these Terms will not exceed the greater of: (a) the fees you paid directly to PilotBooker for the relevant Platform service during the 12 months before the event giving rise to the claim; or (b) USD 100. This cap does not apply where prohibited by mandatory law.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless PilotBooker and its owners, officers, employees, contractors and affiliates from third-party claims, losses, liabilities, penalties, damages and reasonable legal costs arising from your unlawful conduct, material breach of these Terms, User Content, infringement of rights, listing or service, or dispute with another user or provider.

For an individual acting as a consumer, this obligation applies only to the extent the claim was caused by that individual’s unlawful conduct or material breach.

18. Suspension and Termination

You may stop using the Platform at any time and may request account closure, subject to lawful retention requirements. We may warn, restrict, suspend or terminate access; reject or remove listings; or preserve information where we reasonably believe this is necessary to address a breach, fraud, safety concern, legal obligation, reputational risk or threat to the Platform or its users.

Provisions that by their nature should continue after termination—including intellectual property, disclaimers, liability limits, indemnity, governing law and dispute provisions—will survive.

19. Changes to These Terms

We may update these Terms to reflect changes to the Platform, law, security, business practices or user protection. The revised version will show a new “Last updated” date. Where required by law or where changes are material, we will provide additional notice. Continued use after the effective date means you accept the revised Terms, except where law requires express consent.

20. Governing Law and Disputes

These Terms and any non-contractual obligations arising from them are governed by the laws of the State of Wyoming and applicable federal law of the United States, without regard to conflict-of-law rules and without prejudice to mandatory rights that cannot lawfully be excluded in a user’s location.

Before starting formal proceedings, you agree to contact us and allow a reasonable opportunity to resolve the dispute informally. Subject to mandatory law that cannot be waived, the state and federal courts located in Wyoming will have exclusive jurisdiction.

21. General Terms

If any provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent; we may assign these Terms as part of a reorganisation, financing, sale or transfer of the Platform.

These Terms and the policies incorporated into them form the entire agreement between you and PilotBooker regarding the Platform and replace earlier discussions or understandings on the same subject. Headings are for convenience only.
